the Terms of Use Agreement) we may require information that personally identifies you, including for
example, your name, address, email address, physical attributes, athletic ability, skills and
educational background ("Athlete Information"). If you are a Coach (as defined in the Terms of Use
Agreement) we may collect information that personally identifies you, including for example, the name
of your school or program, your name, title, phone number, address, email address, a description of
the types of athletes you are seeking, including the range and skills desired, and description of the
school (“Coach Information” )(collectively with Athlete Information, “Subscriber Information”).

1. Collection of Information. You are required to provide certain Personal Information to us when
you: (a) register for D1; (b) sign up for special offers from selected third parties; or (c) send
email or messages, submit forms, use some of our tools, or send other information. If you are an
Athlete User or a Coach User and you create a user profile ("Profile"), you also provide Personal
Information to us when you post your Personal Information (including physical statistics, athletic
ability, skills, references, education history, photos, videos and bio) in your Profile, or respond
to an inquiry by a User. If you are a Coach User you are permitted to post information about yourself
and/or your school. We may collect Personal Information from you at other points on our site that state
that Personal Information is being collected. In the future, we may also receive certain Personal
Information from third parties that you have authorized to so disclose such information.
2. Disclosure of Information. Unless we tell you otherwise, we do not give, sell or rent your
Personal Information to any third parties without your approval. However, we may give, sell or rent
aggregated (anonymous) information about our users generally.
If you are an Athlete User or a Coach User and include Personal Information (such as your phone
number, address, athletic ability, etc.) in your Profile, you agree that we may disclose such
Personal Information to All Users including other Coach Users. This Personal Information will be
viewable by All Users on the Web Site and such parties may contact you directly based on this
information. In addition, in order to provide you with certain features of the Web Site that will
be provided by our third party partners in the future, we may disclose some of your Personal
Information to these third party partners.
You should note that Personal Information that you voluntarily disclose in any chat rooms, forums,
message boards and/or news groups that are offered on the Web Site may be disclosed to and used by
third parties.
3. Use of Information. We use Personal Information, among other things, to anticipate and resolve
problems with our services, to personalize our services, to personalize our service to you, to
investigate activity that may violate our Terms of Service, to analyze site traffic, and to develop
and market products and services that may be of interest to you. In some instances, we use third
